Preamble
Packymaak operates a platform providing services to both clients and transporters.
This contract governs the relationship between the Packymaak platform and its users. By accepting this contract, the user agrees to all applicable terms based on their role on the platform, whether as a client, a transporter, or both.
1. Definitions
- Packymaak Platform : The online platform allowing clients to send parcels and transporters to deliver these parcels.
- Client : A user who sends a parcel through the platform.
- Transporter : A user who delivers parcels for clients through the platform.
2. General Terms (Applicable to all users)
- Use of the Platform: The user agrees to use the platform in accordance with all applicable laws and regulations.
- Protection of Personal Data: Packymaak agrees to respect the confidentiality of user personal information in compliance with applicable laws (e.g., GDPR).
- Liability Limitation: Packymaak is only liable for losses, delays, or damages related to parcels if a fault in platform management can be demonstrated.
- Platform Service Fees: By using the platform, the user agrees to pay service fees for platform usage, separate from transport fees. These fees are detailed below:
- Clients paying online:
- A fixed fee of 1.5€ for transactions under 20€.
- A fixed fee of 2€ for transactions between 20€ and 50€.
- A fee of 5% of the transaction amount for transactions above 50€.
- Clients paying in cash: A €1 fee is applied to each transaction paid in cash, and the €1 will be paid online to the Packymaak Stripe account. The remaining payment for the delivery will be paid in cash directly to the transporter when they meet.
- Transporters: No fee is currently applied to transporters for using the platform. This free-fee policy is valid for the first version of the platform.
3. Specific Terms for Clients
- Client Obligations: The client agrees to provide accurate and complete information about the parcel, including weight, dimensions, and content.
- Additional Fees for Clients: As a client, service fees apply in addition to transport fees. Example of fees: 5% (excluding VAT) of the total amount or €5 per transaction for online payment. A €1 fee applies for cash payments.
- Claims: If the client experiences a delay or damage in delivery, they may submit a claim within 14 days after delivery.
- Cancellation:
- If the client cancels before the delivery is accepted or if the carrier does not respond for more than 72 hours, a full refund will be processed.
- If the client cancels after the carrier`s acceptance, only the delivery price will be refunded, excluding platform fees.
4. Specific Terms for Transporters
- Transporter Obligations: The transporter agrees to perform deliveries according to Packymaak’s instructions and meet the delivery deadlines.
- Transporter Service Fees: No charge is currently applied to transporters for using the platform. This free-fee policy is valid for the first version of the platform.
- Compensation: The transporter will be compensated for each delivery performed, after the platform service fees are deducted.
- Delivery Delays and Defects: The transporter must report any delays or defects in delivery. The platform may impose penalties for failure to meet deadlines.
5. Updates to the Contract
Packymaak reserves the right to update these terms and conditions at any time. In the case of significant changes, users will be notified by email or through a notification on the platform.
If necessary, they will be invited to sign an amendment formalizing these modifications.
The changes will take effect as soon as the user accepts the new terms. Acceptance of the updated terms will be required before the user can continue using the platform.
